‘URGENT NOTICE’

 

 ‘Kindly note that bpSA terminated its Supply Agreement with Boy 50 in respect of the bpSA Theta Extension 3 Petrol Station in Booysens on 18 July 2024. In the circumstances, this Petrol Station is not supplied with bp fuel and the fuel pumped at this station is not subject to the bp fuel guarantee. Consumers are cautioned regarding the purchase and use of the fuel pumped at this station and are encouraged to use another bpSA fuelling station.  

 

bpSA has made every attempt to dissociate itself from the petrol station at Theta Extension 3, but was unable to access the forecourt for the purposes of de-branding. The branding currently at the Theta Petrol Station is misleading in that bpSA no longer has any association whatsoever with the business operated at this station. The business operated there is conducted by an entity ‘Boy Number 50 (Pty) Ltd’ which has no association with bpSA.  

 

Additionally, bpSA approached the Johannesburg High Court on 20 August 2024 on an urgent basis and obtained a Court Order in the following terms:

  •  that Boy 50 be ordered to permit the designated representatives of bpSA unhindered access to the Property described as erven 49 and 50 Theta Extension 3 Township, Registration Division IQ, Province of Gauteng, measuring 2572 square meters in extent and held by Title Deed T37166/2008 (‘the Premises’) for the purposes of de-branding the petrol filling station situated at the Premises from all bpSA branding, signage and other material identifying the Premises as having any form of association with bpSA, within 1 Business Day of this Order;
  •  that Boy 50 (and all persons occupying the Premises through Boy 50 or in terms of any association with it) be ordered to vacate the Premises within 5 Business Days of this Order; and 
  • that Boy 50 pays the costs of this application, in line with scale B as contemplated in Rule 69 of the Uniform Rules of Court. 

 

Despite the Court Order, Boy 50 continues to occupy the Premises and supply contaminated fuel to customers, under the bpSA branding. Boy 50 sought leave to appeal the Court Order which appeal was dismissed on 26 August 2024.  Boy 50 has now sought to further appeal to a full bench of the Johannesburg High Court.  The full bench appeal will be heard during the week of 9 September 2024.

 

“By way of update, the matter was head before a full bench of the High Court, sitting in Johannesburg, on Wednesday, 11 September 2024. Boy 50 abandoned its relief against bpSA during the hearing and bpSA is now entitled to proceed to de-brand the station. Consumers are reminded that the station had no association with bpSA. 
Consumers are cautioned regarding the purchase and use of the fuel pumped at this station and are encouraged to use another bpSA fuelling station.”

 

As soon as the legal process has been finalised, bpSA will de-brand the Premises and bpSA together with the owner of the premises will proceed to remove Boy 50 from the premises.
